Welcome to Vulcan ("Vulcan," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, software, APIs, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Nature of the Service
Vulcan provides experimental software tools and infrastructure designed to facilitate automated on-chain transaction execution and strategy configuration on blockchain networks.
The Service is:
- Not a broker, exchange, financial advisor, or fiduciary
- Not a provider of discretionary trading or investment management
- Not responsible for the promotion, endorsement, or management of any token or asset
As part of the Service, users are provided access to programmatically controlled wallets ("Execution Wallets") used to carry out automated on-chain transactions based on user-defined parameters. You acknowledge and agree that:
- Execution Wallets are operated and controlled by the Service on your behalf
- The Service holds assets in Execution Wallets in a limited operational capacity — solely for the purpose of executing your configured strategies
- This operational custody is strictly limited in scope: the Service does not invest, lend, rehypothecate, or otherwise use assets beyond executing your instructions
- You authorize the Service to execute transactions through Execution Wallets based on your configured parameters
- All activity performed through your account and associated Execution Wallets is considered authorized by you
Important: While the Service holds assets operationally, it is not a bank, financial institution, or regulated custodian. Assets held in Execution Wallets are not insured, guaranteed, or protected by any government scheme or deposit protection program.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have full legal capacity to enter into these Terms
- Not be located in, or a resident of, any jurisdiction where use of the Service would violate applicable law
We reserve the right to restrict or terminate access at our sole discretion, without notice or explanation.
3. User Responsibility
You are solely responsible for:
- All activity conducted through your account and any configured strategies
- All assets deposited into or withdrawn from the Service
- Maintaining access to the wallet(s) used to authenticate and control your account
- Compliance with all applicable laws, regulations, and rules in your jurisdiction
- The design, deployment, and promotion of any token or asset you are associated with
You acknowledge and agree that:
- Access to the Service is controlled via wallet-based authentication
- If you lose access to your authentication wallet, you may permanently lose access to your account, configurations, and any assets held in associated Execution Wallets
- Vulcan cannot verify ownership of accounts or Execution Wallet balances beyond wallet authentication
- Vulcan cannot recover, reset, or transfer assets in cases of lost wallet access
- All transactions executed via the Service, including those performed through Execution Wallets, are considered to have been authorized by you
4. Prohibited Use
You agree not to use the Service for any unlawful, deceptive, or manipulative purpose, including but not limited to:
- Engaging in or facilitating market manipulation, including wash trading or deceptive trading activity
- Artificially inflating on-chain metrics — including transaction counts, liquidity appearances, or token demand — with the intent to mislead other market participants
- Creating false or misleading impressions of market activity, price, or demand
- Violating any applicable securities, commodities, consumer protection, or anti-fraud laws
- Using the Service in connection with fraud, scams, rug pulls, or deceptive token schemes
- Using the Service to harm, exploit, or mislead other market participants
We reserve the right to suspend or terminate access for any suspected violation, without prior notice and without liability to you.
5. No Financial Advice or Guarantees
The Service is provided for technical and operational purposes only. We do not provide financial, investment, legal, or tax advice. We make no guarantees regarding performance, outcomes, or results of any kind. Any strategies or configurations you deploy are used entirely at your own risk.
You acknowledge that blockchain markets are highly volatile, largely unregulated in many jurisdictions, and experimental in nature.
6. Execution Wallet Risk Acknowledgment
By using the Service, you explicitly acknowledge and accept that:
- Execution Wallets are operated by automated systems on your behalf and are not directly controlled by you in real time
- Transactions may be executed without real-time confirmation once a strategy is configured and active
- Errors in configuration may result in unintended transactions or partial or total loss of deposited assets
- System failures, software bugs, or security vulnerabilities may affect wallet behavior in ways that cannot be fully anticipated or remedied
- Blockchain network conditions, including congestion, forks, or outages, may impact execution outcomes
- Assets held in Execution Wallets are not insured and cannot be recovered by Vulcan in the event of loss due to user error, system failure, or network conditions
You assume all risks associated with depositing assets into and operating Execution Wallets through the Service.
7. Fees and Credits
The Service may require the use of prepaid credits or fees, which may be denominated in SOL or in supported tokens at our discretion. You acknowledge and agree that:
- All payments are final and non-refundable unless otherwise stated in writing
- Pricing may change at any time without notice
- You are solely responsible for all applicable taxes arising from your use of the Service
8. Experimental Technology Disclaimer
The Service is experimental software and may contain bugs, errors, or security vulnerabilities. You acknowledge and accept all risks including but not limited to:
- Smart contract vulnerabilities or exploits
- Execution errors or failed transactions
- Network congestion, delays, or protocol-level failures
- Unexpected or undefined system behavior
Use of the Service is entirely at your own risk. Vulcan provides no warranty, express or implied, as to the fitness, reliability, or security of the Service.
9. Third-Party Dependencies
The Service interacts with third-party infrastructure beyond our control, including:
- Public and private blockchain networks
- RPC providers and node infrastructure
- Decentralised exchanges and liquidity protocols
We are not responsible for: network outages or failures; smart contract exploits on third-party protocols; or any disruption, loss, or damage arising from third-party service failures.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Vulcan and its affiliates, officers, directors, employees, and contractors shall not be liable for any:
- Direct, indirect, incidental, special, or consequential damages
- Loss of funds, digital assets, profits, data, or business goodwill
- Market losses or losses arising from on-chain transaction execution
- Regulatory or legal consequences arising from your use of the Service
Our total aggregate liability to you shall not exceed the total amount you paid to use the Service in the 30 days immediately preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Vulcan and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Any token, project, or digital asset you are associated with
- Any claim by a third party arising from your configuration or deployment of strategies through the Service
12. Right to Suspend or Terminate
We may, at our sole discretion and without prior notice or liability, suspend or terminate your access to the Service, restrict your usage, or investigate suspected misuse. Upon termination, you remain responsible for withdrawing any remaining assets from Execution Wallets within a reasonable timeframe; we are not responsible for assets that cannot be recovered due to access restrictions following a termination for cause.
13. Compliance and Monitoring
We reserve the right, but not the obligation, to monitor usage patterns, investigate suspected misuse, and cooperate with law enforcement or regulatory authorities in connection with lawful requests relating to use of the Service.
14. Intellectual Property
All rights, title, and interest in and to the Service, including its software, design, and documentation, remain the exclusive property of Vulcan. You may not copy, modify, reverse engineer, sublicense, or use our branding or intellectual property without prior written permission.
15. DMCA / Copyright Policy
If you believe content on the Service infringes your copyright, you may submit a takedown request that includes:
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location on the Service
- Your contact information
- A statement of good faith belief that the use is not authorised
We will respond to valid notices in accordance with applicable law.
16. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.
17. Changes to Terms
We may update these Terms at any time by posting a revised version. Your continued use of the Service following the posting of updated Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.

Operational Custody Notice
Vulcan holds digital assets in Execution Wallets solely for operational purposes — to execute the automated on-chain strategies you configure. This limited operational custody does not make Vulcan a custodian, trustee, bank, or regulated financial institution. Assets are not segregated, insured, or protected by any deposit scheme. You should only deposit assets you are prepared to lose in the event of system failure, misconfiguration, or blockchain-level events. Never deposit assets you cannot afford to lose.
